Answering Commonly Asked Probate Questions

Where is probate filed in Palm Beach County?

Probate cases in Palm Beach County are filed with the Circuit Court of the 15th Judicial Circuit, located at the Main Courthouse on North Dixie Highway in West Palm Beach. Under Florida Statute §733.101, probate is filed in the county where the deceased person was living at the time of their passing. If your loved one lived in Boca Raton, Delray Beach, Lake Worth, or anywhere else in Palm Beach County, that’s your court.

It depends on how it was titled. Real property held solely in the deceased’s name generally has to go through formal probate before it can be transferred. But, if the property was held jointly with right of survivorship, a ladybird deed, or placed in a revocable living trust, it passes outside of probate entirely under Florida Statute §689.15. 

Under Florida Statute §733.702, creditors have 90 days from the date of the first publication of the Notice to Creditors (or 30 days from the date they were served directly), whichever comes later. That notice is typically published in a local Palm Beach County publication. If a creditor tries to file a claim afterwards, they’ll be unable to follow through.

It’s possible. Florida law offers a simpler process called Summary Administration under Florida Statue §735.201. This is available when the total value of the probate estate is $75,000 or less, or when the person passed away more than two years ago. 

Having a will does not bypass probate, but it does help make the process a lot smoother. Under Florida Statute §733.201, a will must be deposited with the 15th Judicial Circuit Court within 10 days of the testator’s death. From there, the court validates the will, and the probate process begins.
